Your Priority Date Is Finally Current, Now What?
A “current” priority date can be a major milestone, but it does not always mean a green card or immigrant visa will be issued immediately.
Families sometimes wait many years for a priority date to become current. When the Visa Bulletin finally moves, the natural reaction is: “We are done waiting!” Not quite. Visa availability is essential, but several additional steps can determine whether the case can actually move forward—and the September 2026 Visa Bulletin itself warns that retrogression may become necessary as additional demand materializes.
First: understand the two Visa Bulletin charts
The Visa Bulletin contains a Final Action Dates chart and a Dates for Filing chart. They serve different purposes. For consular immigrant-visa scheduling, visa availability generally turns on the Final Action Date. For adjustment of status inside the United States, USCIS announces which chart applicants may use for filing in a particular month.
What does “current” mean?
When a category is marked “C,” visa numbers are authorized for qualified applicants in that category without a priority-date cutoff. When a date appears, the applicant’s priority date generally must be earlier than the listed cutoff for the relevant purpose.
“Current” means a visa number is available under the applicable chart. It does not erase other eligibility requirements or guarantee immediate approval.
Why can a date move backward?
Visa categories have annual numerical limits. When demand is higher than expected, the Department of State may move a cutoff date backward, known as retrogression, or make a category unavailable. The September 2026 bulletin specifically cautions that retrogression may be necessary in upcoming months as demand materializes.
Families with children: check CSPA immediately
When a long-pending family case finally becomes current, children may be close to or over age 21. The Child Status Protection Act can sometimes preserve classification as a “child,” but the calculation is technical and the applicant may also need to satisfy the “sought to acquire” requirement within one year of visa availability. Do not assume biological age alone answers the question.
Marriage can change a category
A beneficiary’s marriage can have major consequences depending on the petition category and petitioner’s status. For example, some categories require the beneficiary to remain unmarried. Before marrying during a long family-based wait, understand whether the marriage changes, delays or terminates eligibility under the existing petition.
Your checklist when the date becomes current
- Confirm the correct preference category and country of chargeability.
- Locate the priority date on the I-797 approval notice or CEAC.
- Determine which Visa Bulletin chart controls the next step.
- Check CSPA for every derivative child who may be near age 21.
- Make sure NVC fees and documents are complete for consular cases.
- For adjustment cases, confirm USCIS permits use of the relevant chart that month.
- Keep monitoring future bulletins until the visa is actually issued or adjustment approved.
A current priority date opens the door to the next stage. It does not guarantee the door will stay open indefinitely, so families should understand what action is required and whether children or other derivatives face time-sensitive issues.
